Montague Superintendent's Assault Trial Postponed by Judge

The assault trial of Montague School Superintendent Timothy Capone has been postponed by a judge until next month so that the legal guardian of the student that was allegedly assaulted can review video of the incident. According to the New Jersey Herald, the student's legal guardian alleges Capone threw the student on the ground, put his hands on the boy's neck and put him in a chokehold which left visible red marks on his neck.

In addition to pleading not guilty and denying the accusations, Capone has filed a countercharge accusing the 14-year-old of assaulting him.

The student was previously attending an out-of-district program for children with behavioral and special educational needs before being brought back to the Montague school in September. The boy's grandmother reportedly complained about the decision to pull him from the alternative program because he "could pose a danger to himself and others in a mainstream environment."
