The state Attorney General's Office and the Department of Environmental Protection have filed papers in state Superior Court to stop the alleged dumping at Silver Spruce Drive in Vernon. According to the New Jersey Herald, Attorney General Gurbir Grewal and DEP Commissioner Catherine McCabe have asked the court for an injunction to stop Joseph Wallace from accepting any more deliveries of dirt.
They're also asking the court for the following:
- Make Wallace conduct and pay for comprehensive testing of the material in the 75-foot-high dirt pile.
- Let DEP inspectors go on Wallace's property to conduct their own testing.
- Make Wallace pay for the removal of any contaminated materials
Wallace was reportedly issued two violation notices by the DEP for maintenance of an unlicensed solid waste facility and failure to permit entry to DEP inspectors.
