Newton Man Pleads Not Guilty to Sexual Assault of a Minor

A Newton man has pleaded not guilty to sexual assault of a victim under the age of 13. According to the New Jersey Herald, Fernando Diaz was arrested on the charge in December and two hours after being released from custody he was arrested again because the victim found him hiding in the basement of her home.

In an interview with police Diaz initially denied having sexual contact with the girl but admitted to babysitting the woman's children regularly. Later on, he allegedly told police that he "may have accidentally touched" the girl but didn't remember how.

The 38-year-old, who is being held on an Immigrations and Customs Enforcement detainer by the Department of Homeland Security, rejected a plea offer that would have sent him to prison for five years.

Diaz's next court date is set for May 20.
