The attorney for a suspended Ogdensburg police sergeant is looking to have the indictment against his client dismissed. According to the New Jersey Herald, Joseph Sanfilippo is accused of threatening and assaulting his wife last November and when police arrived he allegedly attempted to tackle Patrolman Christopher Geene.

The 31-year-old's attorney, Daniel Colfax, is claiming the prosecutor "muddied the waters" and took "shortcuts" while presenting the case and is moving to dismiss the indictment against his client.

Sanfilippo's next court date is set for May 21.
