The lawyer for the family of Nasir Dickerson does not want the case against the Wallkill Valley Board of Education and Superintendent David Car decided by a Sussex County jury. Eric Warner withdrew the family's lawsuit from Morris County yesterday. Since the case was dismissed without prejudice it can be refiled in Federal Court. The lawyer cited what he called "grotesque" social media postings from residents of Sussex County. Warner was also critical of a Sussex County Prosecutor's Office report that concluded there was not enough evidence to file charges. Wherever the case is tried Warner will have to prove to a jury that a violation of the New Jersey Civil Rights Act or the Federal Civil Rights Act took place.
